New Legislation Allows for Legal Separation in Marriage

Typically, when people think of a married couple separating, divorce comes to mind. However, separation can also occur without legally dissolving the marriage, which can sometimes lead to conflicts and misunderstandings.

Legal separation is when a couple decides to live apart without ending their marital relationship through a divorce.

The newly revised family and persons law, published on July 30, introduces a formal process for legal separation. Articles 274 to 277 outline how one or both spouses can petition the court for a legal separation, allowing them to live apart without terminating the marriage.

There are several reasons couples might opt for legal separation instead of divorce. It can provide a period for reflection and reassessment of the relationship, alleviate financial burdens, or offer a necessary cooling-off period.

The law states, “Legal separation is done under the same conditions and on the same grounds as an application for divorce as provided by the law, or by mutual consent.”

Legal separation claims follow the same procedures as divorce claims. Grounds for divorce, which also apply to legal separation, include adultery, criminal convictions that severely damage reputation, gender-based violence, and refusal to contribute to household expenses, among others.

When both legal separation and divorce claims are filed simultaneously, the court addresses the separation first. After two years of legal separation, either spouse or both jointly can request the court to convert the separation into a divorce. “The application for this conversion is filed following the ordinary rules for divorce applications,” the law specifies.

Under the same law, divorce actions can be initiated by either spouse and must be judged according to regular legal proceedings. Such actions are barred five years after discovering the grounds for divorce.

Implications of Legal Separation

Legal separation releases spouses from the obligation of cohabitation but does not dissolve the marriage or the matrimonial regime. Property management for spouses under legal separation is governed by the matrimonial regime they selected.

The court ruling on legal separation will also determine alimony for the spouse in need. Spouses in legal separation are still responsible for supporting and educating their children. Additionally, the duties of support and fidelity remain binding even after a legal separation judgment.

This new legislation provides a clear and legally protected option for couples to separate without ending their marriage, offering a structured approach to address their needs and concerns.
